Legal Issues

Legal Issues section tells you what the law has to say about the rights of consumers and the obligations of health care providers with respect to linguistic and cultural competence. Much of the information in this area of DiversityRx has been developed by the National Health Law Project through a special grant from the Henry J. Kaiser Family Foundation.


Overview

  Reviews the impact of language barriers on health care and legal protection for limited English speaking patients

Reports

  Features research and reports on the legal basis for linguistically and culturally competent health care services, including the National Health Law Program-Kaiser Family Foundation report on U.S. Laws on Language Barriers and Access to Health Care

Laws

  Offers original text, summaries, and commentaries on federal and state laws governing the role of language and culture in health care delivery. Some of these pages are also accessible from the Policy area of DiversityRx.

HHS Office for Civil Rights
Explains the role of the HHS Office for Civil Rights (OCR) in assuring equal access to health care for participants in federally funded programs, including Medicaid and Medicare. Describes the complaint filing process and reviews the types of decisions made by OCR.

Liability and Malpractice
Looks at the potential liability and malpractice risks of neglecting to account for linguistic and cultural factors that may enter into the provider-patient relationship.

Community Action
Explores the role that community and national organizations can take in promoting and protecting access to health care for minority, immigrant, refugee, and other diverse populations with linguistic and cultural needs.


    As with the rest of DiversityRx, this section is a work in progress and we welcome information on other efforts, programs, and reports that will expand upon the information offered here. Please let us know if you have other examples to include here.
